1. GENERAL TERMS AND CONDITIONS OF SALE
These general terms and conditions of sale (“Terms”) apply to all orders and all sales transactions on the website www.cobbles.store (the “Online Shop”) relating to the products offered for sale on the website www.cobbles.store (the “Products”). The website is owned and operated by COBBLES BV (Ronse, Belgium), company number BE0656827778 (the “Seller”, “we” or “us”, as applicable), acting as the seller of the Products.
Placing an order on www.cobbles.store implies full acceptance, without reservation, of these General Terms and Conditions of Sale. The Seller reserves the right to amend these Terms from time to time. Any changes to the Terms will apply only to orders placed on or after the date of such change.
We recommend that you print a copy of the Terms or save them to your hard drive when you decide to place an order on www.cobbles.store.
2. PLACING AN ORDER ON WWW.COBBLES.STORE
To place an order on www.cobbles.store, you must meet the following conditions:

You have provided us with your name, address, email address, payment information and other required details;

If you have paid by payment card, you must be the lawful owner or authorised holder of a valid payment card in order to purchase Products.

When creating a personal account, you must also create a personal username (your email address) and password. Protect your password at all times and do not share it. You will be held responsible for all purchases made using your username and password.
Orders on www.cobbles.store follow this process:

You select the products;

You enter your payment details and choose a delivery address;

Payment authorisation;

We send you an email confirmation of receipt of the order once payment has been processed;

We collect the payment from your bank account;

We ship the products;

You receive the products.
3. PROCESSING OF THE ORDER
Orders placed on www.cobbles.store are not binding on the Seller. They only become binding on the Seller once the Seller has accepted your order. We have the right to refuse your order for any reason.
Upon receipt of your order, we will send you an email confirming receipt of your order, including your order number and details of the Products ordered. This confirmation of receipt does not constitute acceptance of your order. Acceptance of your order and the conclusion of the sales contract take place if and when the ordered Products are shipped to you. After shipment of the Products, we reserve the right to cancel your order as long as you have not yet received the Products.
We have the right to refuse your order if:

A technical or pricing error occurred on the website www.cobbles.store at the time of ordering;

The ordered Product is not available (in the event that the ordered Product is unavailable, we will inform you by email);

The payment information provided is incorrect or cannot be verified;

Our security systems indicate that the order is abnormal or potentially fraudulent.
In the event that we refuse or cancel an order for any of the above reasons, we will – where applicable – refund the price paid for the Product and any shipping costs paid.
4. PRICES, DELIVERY AND PROCESSING COSTS AND TAXES
The prices stated on the website www.cobbles.store
include VAT. They apply only to orders placed via the website www.cobbles.store. Although we have carefully constructed the website www.cobbles.store, the displayed prices may be incorrect. Incorrectly displayed prices will be corrected as soon as possible and shall not be binding on us.
Separate delivery and processing costs, as well as applicable taxes, are shown at the time the order is placed. Delivery costs are displayed in the shopping cart.
5. AVAILABILITY AND DELIVERY OF PRODUCTS
The Seller does not guarantee that all Products displayed on the website www.cobbles.store are available. The Seller reserves the right, at any time and without prior notice, to modify certain Products, remove them from the range or discontinue their sale.
We aim to deliver ordered Products on time. However, there may be circumstances in which we are prevented from shipping the Products on time and meeting the indicated delivery period. Any delivery time stated by us should therefore be considered a non-binding estimate and not an obligation to achieve delivery of the Products on the estimated delivery date.
Within a reasonable period after delivery, you must check that you have received the Products in good condition and that the contents of the delivered package are complete. It is your responsibility to notify us as soon as possible of any damage to the Products and/or any shortages in the delivered Products.
If you unreasonably delay the delivery or receipt of the Products after we have informed you that we have attempted to deliver them, or if you have provided an incorrect delivery address causing the Products to be returned to us after the first delivery attempt, we will assume that you have exercised your right of withdrawal and we will refund the price paid for the Products in accordance with our return policy and the relevant applicable legal provisions.
6. IMAGES OF PRODUCTS ON WWW.COBBLES.STORE
The display of the colours of the Products on this website depends, among other things, on your monitor settings and the graphics card of the website visitor. The colours shown may therefore differ from the actual colours of the Products.
7. PAYMENT
For the processing of online payments, we work with Wix Payments and Mollie. We do not have access to our customers’ confidential payment details. You may only pay with authorised credit or debit cards. The authorised cards are listed on the website www.cobbles.store. You must provide your card details when placing your order. The charges will be applied upon shipment of the ordered Products. We will only ship the Products after the card issuer has authorised the use of the card for payment of the ordered Products.
8. RETURNS
If you have purchased a Product as a consumer for personal use and wish to exercise your right of withdrawal, you must complete the return form included in your package and return your order to us within 15 days of receiving your parcel.
You also have the right to return Products purchased via the website www.cobbles.store if these Products are defective or non-conforming. In that case, you must submit a return request to our customer service as soon as possible after delivery (maximum 14 days). If our customer service approves your request, you will receive return instructions for the Product(s) by email.
We will only approve return requests if the Product is complete (for example, both items of a pair must be returned together), has not been washed or used in any way, and is returned in its original packaging.
It is your responsibility to ensure that the Products remain safe and protected while in your possession. Please handle the Products with care and return them in the condition in which they were delivered to you. Make sure the Products are properly packaged.
Returns or replacements of the Products can only take place once we have received all Products to be returned.
If you return Products that you 1) were not entitled to return, 2) are no longer in their original condition, 3) are not properly packaged, 4) are incomplete, 5) have not been paid for in terms of delivery, or 6) have not been returned with the necessary care, we reserve the right to refuse your return and deny the requested refund or to charge you for any costs necessary to carry out required repairs, restocking or similar direct costs arising from or related to the amounts to be refunded to you (without prejudice to applicable legal provisions).
9. REFUND
Refunds can only be made once all Products have been returned to us in their original condition and have been received by us. If you chose to pay by credit card, the refund will be credited to that card. If you chose to pay by bank transfer, the refund will be transferred to that account. All refunds will be processed within 15 days after receipt of the returned Products.
10. CIRCUMSTANCES BEYOND OUR REASONABLE CONTROL
We will do everything necessary to fulfil our obligations. However, we cannot be held liable for any delay or failure to perform our obligations if this is caused by circumstances beyond our reasonable control. In the event of a delay, we will perform as soon as reasonably possible.
11. LIABILITY
These General Terms and Conditions describe the full extent of the Seller’s obligations and liabilities with regard to the delivery of Products. To the maximum extent permitted by applicable law, no warranties, conditions or other terms shall be binding on the Seller except as expressly stated in these General Terms and Conditions.
We shall not be liable, whether for breach of contract, tort, indemnity or otherwise, for any economic loss (including but not limited to loss of income, profit and/or turnover or anticipated savings), loss of data, loss of goodwill or damage to reputation, or any other indirect, incidental, special or consequential damages, however caused. Nothing in these General Terms and Conditions shall limit your statutory rights, and nothing in these General Terms and Conditions is intended to limit or exclude liability for fraud or wilful misconduct.
12. PERSONAL DATA
All personal data provided to the Seller via the website www.cobbles.store
will be treated confidentially. The Seller undertakes to handle and process the personal data provided in accordance with the Belgian Act of 8 December 1992 on the protection of personal data. You have the right to access your personal data and to request the correction of inaccurate data by sending a letter to the Seller. The personal data you provide will be used to manage our relationship with you as our customer, for direct marketing purposes and for the global analysis of our customer base. You may, at any time and free of charge, object to the use of your personal data for direct marketing purposes by sending a letter to the Seller.
13. SEVERABILITY
Any provision or part of a provision of these General Terms and Conditions that is unlawful or unenforceable may be severed from these General Terms and Conditions, and the remaining terms or parts of the provision shall remain in full force and effect.
